Dershowitz: “There’s No Crime” In What Trump Said On Cohen Tape

President Donald Trump’s longtime personal attorney and self-proclaimed “fix-it guy” released a tape recorded conversation between him and Trump to CNN on Tuesday.

Of course, in a not-so-shocking fashion, liberal media outlets have made this a bigger deal than it is. Here’s what you need to know:

The backstory of these tapes has to do with former Playboy model Karen McDougal’s claim that Trump had an affair with her.

This, in and of itself, is not new information. The information about this alleged affair broke in February.

Exclusive rights for McDougal’s story about the affair were purchased for $150,000 by the parent company of the National Enquirer, American Media Inc., whose chairman David J. Pecker is a close friend of Trump’s. McDougal alleges that her story was bought by AMI specifically for the purpose of ensuring it would not be made public.

On the Cohen tape, Trump is allegedly referring to AMI paying McDougal when he says, “So, what do we got to pay for this? One-fifty?”

If Trump is indeed referring to paying off McDougal for the purposes of protecting his election campaign, this could be seen as an illegal campaign expenditure.

However, there is no indication of this, as constitutional scholar and former Harvard Law professor Alan Dershowitz told “Fox & Friends” on Tuesday night.

“Not even a close question. There’s no crime,” Dershowitz said. “The end result is cash was not used. No payments were made.”

Instead, Dershowitz suggests it’s Cohen who might be in trouble for making this tape and breaking attorney-client privilege with its release.

“If it fact this material was originally leaked by Cohen when it was still privileged — remember, a judicial officer found it to be privileged — it then was leaked. Only after it was leaked did [Rudy] Giuliani waive the privilege as to this in order to protect the privilege as to any other possible conversations. If Cohen is the source of the leak, he has a serious problem,” Dershowitz said.

He also pointed out, “This was a conversation between a lawyer and a client that should never have been heard.”

With this, Trump agrees, tweeting the following on Wednesday:

Donald J. Trump

@realDonaldTrump

What kind of a lawyer would tape a client? So sad! Is this a first, never heard of it before? Why was the tape so abruptly terminated (cut) while I was presumably saying positive things? I hear there are other clients and many reporters that are taped – can this be so? Too bad!

So, what is the Cohen investigation really about? It’s unclear. It seems to be more of an drama-filled entertainment TV show rather than a criminal investigation.
